Tsumagoi Bicycle Rental Service "Tsumachari"

Welcome to Tsumagoi Panorama Rental Bicycles (Tsumachari). Please read and follow these rules before using the service.

When riding, always follow the Five Bicycle Safety Rules:

  1. Ride on the road whenever possible; sidewalks are for exceptions only.

  2. Keep to the left side of the road.

  3. On sidewalks, give priority to pedestrians and ride slowly near the edge of the road.

  4. Follow all traffic and safety rules.

  5. Children must wear a helmet.

Additional Rules:

  • No riding after drinking alcohol.

  • No double-riding or riding side by side.

  • Turn on the lights at night.

  • Obey traffic signals, stop at intersections, and check for safety before proceeding.

Chapter 1 – General Provisions

Article 1 (Definitions)

The following terms in these Terms of Use shall have the meanings set out below:

  • Cycle Sharing System
    A system in which members can rent and return shared bicycles at designated ports during the service operating hours.

  • Member
    An individual who has entered into a membership agreement with the Tsumagoi Village Tourism Association (hereafter “the Association”) under Article 3 to use the Cycle Sharing System. Individual members are those who join as private persons.

  • Shared Bicycle
    A bicycle provided by the Association for use by members within the Cycle Sharing System.

  • Port Sharing
    Locations for borrowing, returning, and storing shared bicycles.

  • Attachment
    The lock control device installed on the shared bicycle.

  • Operations Office
    The base responsible for maintaining the bicycles and ports, and for supporting members.

Article 2 (Application of Terms)

  1. The Association operates the Tsumagoi Panorama Rental Bicycle service (hereafter “the Service”) and offers bicycles to individual members who have signed a membership agreement in accordance with these Terms. During the membership period, individual members may borrow shared bicycles from the system. Matters not specifically addressed in these Terms shall be governed by applicable laws or common practices.

  2. The Association may issue a User Guide. In the event of any conflict between these Terms and the User Guide, the provisions of the User Guide shall take precedence.

  3. These Terms apply to all members of the Service.

Chapter 2 – Membership Agreement

Article 3 (Conclusion of Membership Agreement)

  1. Individuals wishing to join the Cycle Sharing System must agree to these Terms and submit a membership application using the method specified by the Tsumagoi Village Tourism Association (“the Association”). Applicants under the age of 18 must obtain prior consent from a parent or guardian.

  2. The membership agreement is concluded when the Association accepts the application submitted by an individual wishing to join.

  3. The Association may refuse to conclude a membership agreement if the applicant falls under any of the following:

    1. Height is less than 145 cm.

    2. The Association determines that the applicant cannot safely operate a shared bicycle due to physical limitations.

    3. The applicant has outstanding payments for previous bicycle rentals.

    4. The applicant is a member of, or affiliated with, organized crime or other antisocial forces.

    5. The applicant is under 13 years old and cannot commit to wearing a helmet.

    6. The applicant does not agree to these Terms.

    7. Other reasons deemed inappropriate by the Association.

  4. Only individual members are allowed to use the shared bicycles.

Article 4 (Membership Conditions)

  1. Members must select one membership type and payment method as specified by the Association when concluding the membership agreement.

  2. Members must pay the fees associated with the selected membership type and payment method as described in Chapter 5.

  3. Locations of bicycle ports will be published on the Association’s official website.

Article 5 (Changes to Registration Information)

  1. Members must immediately notify the Association of any changes to personal information, selected membership type, or payment method, and obtain the Association’s approval.

  2. If the Association determines that the notified changes interfere with the operation of the service, it may refuse the changes or terminate the membership agreement.

Article 6 (Termination of Membership Agreement)

The Association may temporarily suspend service or terminate the membership agreement without notice if the member:

  1. Violates these Terms.

  2. Causes a traffic accident while using the shared bicycle (including connected shared bicycles).

  3. Fails to pay fees or other charges defined in Chapter 5 even once.

  4. Falls under any of the conditions in Article 3, Paragraph 4.

  5. Other cases where the Association deems continued use inappropriate, such as inability to contact the member or false information provided at registration.

Article 7 (Suspension of Service)

  1. If the Association determines that it is difficult to continue the service due to the unavailability of bicycles, the system, or other reasons, it may suspend the service at its discretion.

  2. In such cases, the membership agreement ends upon notification to the member, and the member is not required to pay any basic fees for the period after termination (only if basic fees apply under the selected plan).

Article 8 (Early Termination by Member)

Members may terminate the membership agreement with the Association’s consent. In such cases, members must pay basic fees up to the date of termination (only if basic fees apply under the selected plan).

Article 9 (Term of Membership Agreement)

The membership agreement is valid from the date of conclusion until the end of the service (including any successor service). If the selected membership type specifies a validity period, that period takes precedence.

Article 10 (Service Period)

The Association will publish the service period on its official website. The service period may change without notice due to weather or other operational reasons.

Article 11 (Temporary Suspension, Interruption, and Resumption)

  1. The Association may temporarily suspend or interrupt all or part of the service in the following cases:

    1. Routine or emergency maintenance of system equipment.

    2. Malfunctions that prevent full or partial operation.

    3. Natural events, local events, or other circumstances making safe operation difficult.

    4. Operational or technical reasons requiring temporary suspension.

  2. In such cases, the Association will notify members through the website or other appropriate methods. In emergencies, this may not be possible. Resumption of service will follow the same procedures.

  3. The Association is not responsible for any damages incurred by members during temporary suspensions or interruptions, and fees for the interrupted period will not be refunded.

Article 12 (Management of ID, Passwords, etc.)

  1. Members must properly manage their issued ID, password, and other access codes (collectively “IDs”) and must not disclose or allow others to use them.

  2. Except in cases caused by the Association, the Association is not responsible for the management of IDs, and all actions by third parties using the member’s IDs are considered the member’s responsibility.

  3. If a member’s ID is stolen, misused, or suspected of misuse, the member must immediately notify the Association.

Chapter 3 – Bicycle Rental and Return Procedures

Article 13 (Bicycle Rental Procedure)

  1. Individual members must unlock a shared bicycle using the attachment control panel according to the method specified by the Association. This process (the “Check-Out Procedure”) constitutes the individual rental agreement (the “Individual Agreement”), under which the Association provides the member with the shared bicycle.

  2. The Association may refuse to rent out a bicycle for operational reasons or other circumstances related to the Cycle Sharing System (including linked systems, hereafter “Cycle Sharing System, etc.”).

  3. Members may not make any claims against the Association if a rental is refused under the preceding paragraph.

Article 14 (Reservations and Cancellations)

  1. If a member has chosen a system requiring a passcode for unlocking each time, they must request the passcode in advance for each use according to the method specified by the Association. Members must specify the port (including linked ports, hereafter “Port, etc.”) and the desired bicycle when making a reservation. The Association will accommodate the request as far as possible, considering other reservations.

  2. If the Check-Out Procedure (Article 13, Paragraph 1) is not completed within the period specified by the Association after making a reservation, the reservation is automatically canceled, and members accept this condition.

  3. The Association may cancel a reservation unconditionally if it becomes impossible to provide the bicycle under the reserved conditions, even after the reservation is confirmed.

  4. Members may not make any claims against the Association for cancellations made under the preceding two paragraphs.

Article 15 (Bicycle Return Procedure)

  1. Returns must be completed at a Port, etc. where the bicycle can be stored. Members complete the return by locking the bicycle and using the attachment control panel to notify the Association (the “Check-In Procedure”). The Individual Agreement ends upon completion.

  2. Members must ensure they have removed all personal belongings before returning the bicycle. The Association is not responsible for any lost items.

  3. If a Port, etc. is unavailable, members must move the bicycle to another available Port and complete the Check-In Procedure there.

  4. In emergencies where the bicycle cannot be moved to another Port, members must contact the Operations Office and follow instructions.

  5. If a member leaves the bicycle outside a Port without notifying the Operations Office or following instructions, the Check-In Procedure is considered incomplete. The Association may complete the Check-In Procedure on the member’s behalf without prior notice if deemed necessary.

Article 16 (Termination of Individual Agreement)

The Association may require the return of a bicycle if any of the following occurs:

  1. The bicycle becomes unusable during the rental period, or system malfunctions or other issues make continued use impossible.

  2. The member violates these Terms or any other agreement with the Association during the rental period.

Chapter 4 – Bicycle Accidents and Handling Procedures

Article 17 (Accident Handling)

  1. If an accident occurs while a member is using a shared bicycle, regardless of the scale of the accident, the member must follow legal procedures and take the following steps:

    1. Immediately report the accident to the local police and the Operations Office.

    2. Promptly submit any documents or evidence requested by the Association or its designated insurance company.

    3. If settling or negotiating with a third party, obtain prior approval from the Association.

  2. In addition to the above, members are responsible for handling and resolving the accident at their own risk and expense.

Article 18 (Malfunctions, Theft, etc.)

  1. If a member notices any abnormality or malfunction in the shared bicycle or the port during use, they must stop using it immediately, contact the Operations Office, and follow its instructions.

  2. If theft occurs during the rental period, members must immediately report the incident to the police and the Operations Office and follow the Operations Office’s instructions. In such cases, members must pay the amount specified by the Association to cover the theft.

Article 19 (Battery Depletion)

If the battery of a shared bicycle runs out or is at risk of running out during the rental period, members must immediately report the situation to the Operations Office and follow its instructions, including returning the bicycle to the nearest available port or taking other necessary measures.

Article 20 (Insurance and Compensation)

  1. While a member is using a shared bicycle under an active rental agreement, the Association provides insurance coverage under the following conditions:

    1. Personal injury:

      • Death or permanent disability: 10,000,000 JPY

      • Hospitalization: 5,000 JPY per day (up to 180 days from the accident)

      • Outpatient treatment: 2,500 JPY per day (up to 90 days from the accident)
        Coverage applies only while riding the bicycle and covers sudden and accidental external injuries.

    2. Liability insurance:

      • Bodily injury and property damage: up to 200,000,000 JPY

      • Legal support: up to 10,000,000 JPY

      • Initial response costs: up to 10,000,000 JPY

      • Victim injury compensation: up to 500,000 JPY per person (includes 30,000 JPY for gifts)
        Covers legal liability for damages caused to third parties’ life, body, or property while riding the bicycle.

  2. Any damages exceeding the limits above are the responsibility of the member.

  3. Members agree that accidents not reported to the police or Operations Office, or accidents caused by violation of these Terms, may not be covered by insurance or Association compensation.

  4. Insurance may not cover cases excluded under the insurance policy, and members are responsible for any such damages.

Chapter 5 – Fees

Article 21 (Fees)

  1. “Fees” refer to all charges that a member must pay to the Association when using a shared bicycle, including the basic fee, extension fees, and any other applicable charges.

  2. The Association will clearly indicate each fee or the method of calculation in the fee schedule, which will be published on the Association’s official website. Any changes to the fee schedule will be posted on the website at least one week before the effective date.

Article 22 (Basic Fee)

The basic fee refers to the amount determined by the contract type selected under Article 4, Section 1, or as updated under Article 5, Section 1.

Article 23 (Extension Fees)

  1. Extension fees are charged when a member uses a shared bicycle beyond the initial usage time specified for their contract type.

  2. Extension fees are calculated from the end of the initial usage period until the return procedure described in Article 15 is completed.

Article 24 (Payment of Fees)

  1. Members must pay the fees described in Article 21 using the payment method selected under Article 4, Section 1, or as updated under Article 5, Section 1.

  2. If payment cannot be completed using the selected method, the Association may collect payment using an alternative method determined by the Association.

Chapter 6 – Member Responsibilities

Article 25 (Regular Inspection and Maintenance)

The Association shall conduct regular inspections and maintenance of shared bicycles and ports in accordance with the standards established by the Association.

Article 26 (Pre-Use Inspection)

  1. Each member must check before each use that the shared bicycle is in a safe and operable condition, including brakes, handlebars, tire pressure, bell, attachment control panel, and battery level.

  2. If a member discovers any damage, missing components, or maintenance issues, they must immediately contact the Operations Office and cease use of the bicycle.

  3. If a member uses a shared bicycle without reporting any such issues, the bicycle shall be deemed to have been in proper condition at the time of rental.

Article 27 (Custodial Responsibility)

  1. Members must exercise the care of a prudent manager when using and storing shared bicycles.

  2. Custodial responsibility begins when the individual rental contract is completed at the time of unlocking the bicycle and ends when the bicycle is properly returned and the return procedure is completed.

Article 28 (Prohibited Conduct)

During the rental period, members must not engage in the following activities:

  1. Allowing anyone other than the registered member to use the bicycle.

  2. Reckless or intoxicated riding.

  3. Violating traffic regulations while using the bicycle.

  4. Riding in prohibited parks, dangerous areas, or otherwise inappropriate locations.

  5. Obstructing pedestrians or other traffic.

  6. Modifying, removing, or altering the bicycle, its devices, or accessories.

  7. Parking in prohibited areas, private property without permission, or places that obstruct traffic.

  8. Continuing to ride a malfunctioning bicycle.

  9. Using the bicycle for tests, competitions, towing, or pushing.

  10. Retaining the bicycle beyond its intended use, e.g., holding it overnight or at private premises.

  11. Riders under 13 years old must wear a helmet.

  12. Any conduct violating laws or public order and morals.

Article 29 (Handling of Improperly Parked Bicycles)

  1. Members are responsible for all costs, fees, and damages incurred if they park the bicycle in prohibited locations as described in Article 28(7).

  2. If the Association receives a report from local authorities or the police about a parked bicycle, the member must promptly move the bicycle to a location designated by the Association and comply with any legal measures.

  3. If the Association advances any costs for such matters, the member must promptly reimburse the Association.

Article 30 (Return Obligation)

Members must return the bicycle in the same condition as when rented, excluding normal wear and tear. Members are responsible for all costs of repairs, replacement of parts, or restoration if damage, loss, or theft occurs due to their fault.

Article 31 (Measures for Unreturned Bicycles)

  1. If a member fails to return the bicycle within the allowed rental period, ignores return requests, delays payments, or becomes untraceable, the Association may terminate the membership contract and take legal action, including criminal prosecution.

  2. In such cases, the member is liable for all usage fees, collection costs, and any damages incurred by the Association until the bicycle is returned.

  3. However, the member is not liable for damages caused by natural disasters or other force majeure events preventing timely return. In such cases, the member must immediately contact the Operations Office and follow its instructions.

Article 32 (Liability for Damages)

Members are responsible for compensating any damages caused to third parties or the Association while using the shared bicycle, except in cases where the member is not at fault.

Chapter 7 – Disclaimer

Article 33 (Disclaimer)

Regardless of the reason, members may not claim compensation from the Association for any damages arising from the use of shared bicycles or the inability to use them, except in cases where the Association has acted with intent or gross negligence. In such cases, compensation shall not exceed the amount paid by the member to the Association for the use of the shared bicycle.

Chapter 8 – Personal Information

Article 34 (Purpose of Use of Personal Information)

  1. The Association shall use personal information of members obtained through applications, membership contracts, updates to registration information, GPS tracking and route data from shared bicycles, and other business-related activities, solely for the following purposes:

    1. To make appropriate decisions and take necessary actions regarding membership applications and approvals.

    2. To manage the operations of the cycle sharing system, including communications, sending documents, and identity verification.

    3. To issue billing for the use of shared bicycles.

    4. To appropriately manage membership contracts and individual rental contracts, including post-termination inquiries and legally required record-keeping.

    5. To provide information regarding services, products, events, and campaigns offered by the Association.

    6. To perform operational and management tasks such as creating statistical reports and conducting analyses necessary for business and management purposes.

    7. To collect and analyze data through surveys or interviews for assessing the effectiveness of projects conducted by implementing municipalities or the Association, and to use or provide anonymized statistical information for research, marketing, or other business purposes.

  2. When outsourcing operations related to the management of the cycle sharing system (e.g., computer operations, payment processing, customer management, and inquiries), the Association may entrust personal information to contractors with adequate data protection measures.

  3. Members may request disclosure of their personal information held by the Association. If any information is found to be inaccurate or incorrect, the Association shall promptly correct or delete it. Chapter 9 – Miscellaneous

Article 35 (Amendment of Terms)

If the Association revises these terms, posting on the Association’s designated website shall constitute notice to members. Revisions may be made without prior notice to members.

Article 36 (Notices)

Notices or communications from the Association to members shall be sent to the phone number and email address registered at the time of membership. Such notices take effect upon transmission, and members bear any disadvantage resulting from non-receipt.

Article 37 (Late Payment Penalty)

If a member fails to fulfill any monetary obligation under these terms or the membership contract, the member shall pay the Association a late payment penalty at an annual rate of 14.6% (calculated on a daily basis, assuming 365 days in a year).

Article 38 (Jurisdiction)

Any disputes arising from these terms or the membership contract shall be subject to the exclusive jurisdiction of the district court or summary court in the first instance.
